PRIVACY NOTICE - PERSONAL DATA

Your personal data - what is it?

"Personal data" can refer to any information that is related to an identifiable natural person. Examples can include a name, email address, address etc. The processing of personal data is governed by the Data Protection Bill/Act 2017 the General Data Protection Regulation 2016/679 (the "GDPR") and other legislation relating to personal data and rights such as the Human Rights Act 1998.

This Privacy Notice is provided to you by Conifer who is the data controller for your data. Conifer is a Security and Hospitality staffing company. We provide a range of staffing solutions including SIA qualified security guards and professional and experienced hotel staff. We aim to deliver the best quality service our clients expect.

What data do the data controllers listed above process?

The data control person will process some or all of the following where necessary to perform their tasks:

  • Contact details such as telephone & mobile numbers
  • Email address
  • Registered address/company house number
  • Position held in the company (person signing the contract)

How do we process your personal data?

The data controllers will comply with their legal obligations to keep personal data up to date; to store and destroy it securely; to not collect or retain excessive amounts of data; to keep personal data secure, and to protect personal data from loss, misuse, unauthorised access and disclosure and to ensure that appropriate technical measures are in place to protect personal data.
We use your personal data for some or all of the following purposes:

  • To enable us to meet all legal and statutory obligations (which includes maintaining our client records).
  • To maintain our own accounts and records.
  • To notify you of changes to rates.
  • To send you communications which you have requested and that may be of interest to you. This may include information of you to the ConiferGB staff e.g. registered address, point of contact (name of the person), emails, telephone & mobile numbers.

What is the legal basis for processing your personal data?

Most of our data is processed because it is necessary for our legitimate interests. An example of this would be contacting and informing you of the changes to rates. We will always take into account your interests, rights and freedoms We may also process data if it is necessary for the performance of a contract with you, or to take steps to enter into a contract. An example of this would be processing your data in connection with your collaboration with Conifer.. Where your information is used other than in accordance with one of these legal bases, we will first obtain your consent to that use.

Sharing your personal data

Your personal data will be treated as strictly confidential. It will only be shared with third parties where it is necessary for the performance of our tasks or where you first give us your prior consent. It is likely that we will need to share your data with some or all of the following (but only where necessary):

  • Personal data will be shared with Conifer staff. If the staff are working with you, the Conifer staff will need to know certain information e.g. point of contact (name of the person), telephone & mobile numbers, emails.

How long do we keep your personal data?

We will keep some records permanently if we are legally required to do so. We may keep some other records for an extended period of time. For example, it is currently best practice to keep financial records for a minimum period of 7 years to support HMRC audits. In general, we will endeavour to keep data only for as long as we need it. This means that we may delete it when it is no longer needed.

Your rights and your personal data

You have the following rights with respect to your personal data:
When exercising any of the rights listed below, in order to process your request, we may need to verify your identity for your security. In such cases we will need you to respond with proof of your identity before you can exercise these rights.

  • The right to access information we hold on you
    • At any point you can contact us to request the information we hold on you as well as why we have that information, who has access to the information and where we obtained the information from. Once we have received your request we will respond within one week.
    • There are no fees or charges for requests.
  • The right to correct and update the information we hold on you
    • If the data we hold on you is out of date, incomplete or incorrect, you can inform us and your data will be updated.
  • The right to have your information erased
    • If you feel that we should no longer be using your data or that we are illegally using your data, you can request that we erase the data we hold.
    • When we receive your request we will confirm whether the data has been deleted or the reason why it cannot be deleted (for example because we need it for our legitimate interests or regulatory purpose(s)).
  • The right to object to processing of your data
    • You have the right to request that we stop processing your data. Upon receiving the request, we will contact you and let you know if we are able to comply or if we have legitimate grounds to continue to process your data. Even after you exercise your right to object, we may continue to hold your data to comply with your other rights or to bring or defend legal claims.

    • You have the right to request that we transfer some of your data to another controller. We will comply with your request, where it is feasible to do so, within one month of receiving your request.

    MODERN SLAVERY

    POLICY POLICY STATEMENT

    Modern slavery is a crime and a violation of fundamental human rights. It takes various forms, such as slavery, servitude, forced and compulsory labour and human trafficking, all of which have in common the deprivation of a person's liberty by another in order to exploit them for personal or commercial gain. We have a zero-tolerance approach to modern slavery and we are committed to acting ethically and with integrity in all our business dealings and relationships and to implement and enforce effective systems and controls to ensure modern slavery is not taking place anywhere in our own business or our supply chain.

    We are also committed to ensuring there is transparency in our own business and in our approach to tackling modern slavery throughout our supply chain. We expect the same high standards from all of our contractors, suppliers and other business partners. As part of our contracting processes, we include specific prohibitions against the use of forced, compulsory or trafficked labour, or anyone held in slavery or servitude and we expect that our suppliers will hold their own suppliers to the same high standards.

    This policy applies to all persons working for us or on our behalf in any capacity, including employees at all levels, directors, officers, security guards, agency workers, seconded workers, volunteers, agents, contractors, external consultants, third-party representatives and business partners. This policy does not form part of any employee's contract of employment and we may amend it at any time.

    RESPONSIBILITY FOR THE POLICY

    Top management has overall responsibility for ensuring this policy complies with the legal and ethical obligations, and that all those under our control comply with it the top management has primary and day-to-day responsibility for implementing this policy, monitoring its use and effectiveness, dealing with any queries about it, and auditing internal control systems and procedures to ensure they are effective in countering modern slavery.

    Management at all levels are responsible for ensuring those reporting to them understand and comply with this policy and are given any required training.

    COMPLIANCE WITH THE POLICY

    You must ensure that you read, understand and comply with this policy. The prevention, detection and reporting of modern slavery in any part of our business or supply chain is the responsibility of all those working for us or under our control. You are required to avoid any activity that might lead to, or suggest, a breach of this policy. You must notify your manager as soon as possible if you believe or suspect that a conflict with this policy has occurred, or may occur in the future. You are encouraged to raise concerns about any issue of suspicion of modern slavery in any parts of our business or the supply chains of any supplier tier at the earliest possible stage.

    We aim to encourage openness and will support anyone who raises genuine concerns in good faith under this policy, even if they turn out to be mistaken. We are committed to ensuring no one suffers any detrimental treatment as a result of reporting in good faith their suspicion that modern slavery of whatever form is or may be taking place in any part of our own business or in any part of our supply chain. If you believe that you have suffered any such treatment, you should inform your manager immediately.

    COMMUNICATION AND AWARENESS OF POLICY

    Training on this policy, and on the risk our business faces from modern slavery in its supply chain will be given where needed.

    Our zero-tolerance approach to modern slavery must be communicated to all suppliers, contractors and business partners at the outset of our business relationship with them and reinforced as appropriate thereafter.

    BREACHES OF THIS POLICY

    Any employee who breaches this policy will face disciplinary action, which could result in dismissal for misconduct or gross misconduct.

    We may terminate our relationship with other individuals and organisations working on our behalf if they breach this policy.
